Before you join COROS boatshare, you must agree that you have read and
understood the condition listed below, you must also agree that you will
attend the instruction prior to participating in the cruising and will
follow the directions of any agent or servant of the boat owner during
the course of the activity. Participants under the age of 18 year must
have this waiver signed by a parent or Guardian.
Cruising Liability Waiver
I wish to engage in the boat sharing cruising activity conducted by the
boat owner. In consideration of the boat owner providing the above
mentioned cruising. I agree to pay such fuel and maintenance fee as may
from time to time be fixed by the company and I agree on my own behalf
and on behalf of my executors, administrators and accept that I will be
bound by the following terms and conditions.
1. I DO HEREBY ACKNOWLEDGE that I am engaging in the abovementioned
cruising activity on my own free will and at my own risk absolutely.
2. I acknowledge that under the Civil Liability Act. boat owner,
servants and agents will not be liable for the harm suffered by me due
to the materialization of an obvious risk due to my participation in
cruising activity and further acknowledge that this activity has a risk.
3. I hereby warrant that I am in good health, that I am not receiving
any medication, that I am not under influence of alcohol or taking any
drug whatever and that I am free from any injury, medical condition
(including pregnancy, heart condition or seizure), disability, disease
or illness which may be aggregated by participation in the
abovementioned cruising activity, or may affect or interfere with my
ability to engage in the cruising activity.
4. The boat owner, servants or agents, shall be under no liability to
me, and I Indemnify the boat owner, servants or agents against the
costs, losses or claims of others, for any damage to person or property
including death, personal injury or loss of any nature whatsoever
occurring during or incidental to or as a consequence, direct or
indirectly by any act or default of any kind or description whatsoever
on the part of the boat owner, servants or agents (including any
independent contractor, sub-contractor, licensee or other officer
whatsoever from time to time employed, licensed or directed by the boat
owner) or by me or minors under any control.
5. I for myself, my administrators, assign and dependants expressly
renounce all liability in and other claims against the boat owner.
6. I will at all times within the duration of the abovementioned
cruising activity and in all circumstances whatsoever comply with any
direction whatsoever given to me by any servants or agents (including
any independent contractor, sub-contractor, licensee or other officer
whatsoever as aforesaid) of the boat owner.
7. No servant or agent of the boat owner (including any independent
contractor, sub-contractor, licensee or other officer whatsoever as
aforesaid) shall in any circumstance whatsoever be under any liability
whatsoever to me, my executors, administrators, assigns and dependants
for any such damage as aforesaid caused directly or indirectly by any
acts or default of any kind of description whatsoever.
8. The parties hereby expressly agree that this Agreement shall be
construed and take effect in accordance with the law of New South Wales
for the time being in force.
9. in the event that any provision or part thereof of this agreement be
invalid or unenforceable such invalidity or unenforceability shall not
affect the validity or enforceability of the remaining provision of this
agreement and the invalid or unenforceable provision or part thereof
shall be severed.
